Copyright and DMCA Policy
[TODO: legal entity name] respects the intellectual property rights of others and responds to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act, 17 U.S.C. 512 (the "DMCA"). This policy covers the website at lobbylabs.net. For content in our repositories on a third-party code hosting platform, use that platform's copyright process.
1. Designated agent
Send copyright notices and counter-notices to our designated agent:
[TODO: DMCA agent name]
[TODO: legal entity name]
[TODO: postal address or PO box], Dallas, TX [TODO: ZIP]
Phone: [TODO: DMCA agent phone]
Email: copyright@lobbylabs.net
This address is only for copyright notices. Other messages sent to it will not receive a response.
2. Notice of infringement
If you believe material on the site infringes your copyright, send our agent a written notice that includes all of the following (17 U.S.C. 512(c)(3)):
- A physical or electronic signature of the copyright owner or a person authorized to act on the owner's behalf.
- Identification of the copyrighted work you claim has been infringed or, if multiple works are covered by a single notice, a representative list of them.
- Identification of the material you claim is infringing and that you want removed or disabled, with enough information for us to find it, such as the exact URL.
- Your name, mailing address, telephone number, and email address.
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act on the owner's behalf.
Before sending a notice, consider whether the use could be fair use or otherwise permitted. A notice that is missing required elements may not be effective.
3. Counter-notice
If material you provided was removed or disabled because of a notice and you believe that was a mistake or misidentification, you may send our agent a written counter-notice that includes all of the following (17 U.S.C. 512(g)(3)):
- Your physical or electronic signature.
- Identification of the material that was removed or disabled and the location where it appeared before it was removed or disabled.
- A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if your address is outside the United States, any judicial district in which [TODO: legal entity name] may be found), and that you will accept service of process from the person who sent the original notice or that person's agent.
When we receive a valid counter-notice, we will send a copy to the person who sent the original notice. Unless that person tells us within 10 business days that they have filed a court action seeking to restrain the alleged infringement, we will restore the material between 10 and 14 business days after we receive the counter-notice.
4. False notices
Under 17 U.S.C. 512(f), anyone who knowingly and materially misrepresents that material is infringing, or that material was removed by mistake, may be liable for damages, including costs and attorneys' fees.
5. Repeat infringers
In appropriate circumstances, we will remove from the early-access list, and block access to the site for, anyone who is found to repeatedly infringe the copyrights of others.
